In short

How a real estate lawyer helps with a purchase in Ukraine

The lawyer of Premium Estate checks the seller's title and documents, tells you which consents and certificates are missing, prepares the deal and supports you until the sale and purchase contract is signed at the notary. If you are abroad, you can sign through a representative under a power of attorney. A consultation is 30 minutes online for €100, a written opinion from €200.

What legal support includes

Six areas of the lawyer's work. They can be ordered together with a purchase or sale through the agency or separately.

  1. 01

    Document review

The seller's title document, the extract from the State Register of Real Property Rights, the technical passport, the owner's marriage and children documents. We tell you what is in order, what needs to be obtained and what risk each gap carries.

  2. 02

    Support at any stage

We join before the deposit, before the contract is signed or when the deal is already under way: the deposit and preliminary agreement, the payment procedure and the handover of the apartment.

  3. 03

    The contract at the notary

A contract for the sale of an apartment is notarised in Ukraine (Art. 657(1) of the Civil Code of Ukraine). The lawyer collects the documents with you, checks the terms of the contract and supports you until it is signed.

  4. 04

    Representation before third parties

We negotiate and correspond with the other party and its representatives on your behalf, within the powers you give us.

  5. 05

    Permits and licences for businesses

For companies and sole proprietors we help obtain the necessary permits and licences.

  6. 06

    BTI, valuation, land

If the deal needs a new technical passport, an appraiser's report or land documents, the agency helps with BTI, appraisers and land management work.

How working with the lawyer goes

Five steps from the request to the signed contract. Scope and price of the support are agreed after the consultation.

  1. 1RequestForm, call or e-mail: the property, the deal, your question.
  2. 2Consultation30 minutes online — €100, or written — from €200.
  3. 3Document reviewTitle, encumbrances, consents, the other party's documents.
  4. 4Deal preparationTerms, payment, missing certificates, the notary package.
  5. 5ContractSigning at the notary in person or by representative.
Steps 1–2 are enough if you only need the lawyer's answer. Steps 3–5 are transaction support, which can start at any stage.

Buying property in Ukraine as a foreigner

What the law allows and what you need before the deal.

  • Apartments, houses, commercial premises. Foreign citizens can buy them. Agricultural land is the exception: foreigners cannot own it, and agricultural land received by inheritance must be sold within a year. Non-agricultural land within settlements, and land under buildings the foreigner owns, can be acquired (Art. 81 of the Land Code of Ukraine).
  • Taxpayer registration number. To sign at the notary a foreign buyer needs a Ukrainian taxpayer registration number (RNOKPP), issued by the State Tax Service (Art. 70 of the Tax Code of Ukraine).
  • Language. The contract is drawn up in Ukrainian. If you do not speak it, plan for a translator at the signing; documents issued abroad need a certified Ukrainian translation.
  • Signing from abroad. A representative can sign under a power of attorney. Because the purchase contract is notarised, the power of attorney must be notarised too (Art. 245(1) of the Civil Code). You can sign it at a Ukrainian consulate, or at a local notary with an apostille: Ukraine has been a party to the Hague Apostille Convention since 22 December 2003 (HCCH status table).

Questions about your own case, such as payment, the currency of the deal or the documents you have, the lawyer answers in a 30-minute online consultation for €100.

Questions clients bring to the lawyer

Common situations in apartment deals and what the law says.

  • The seller bought the apartment while married. The notarised consent of the spouse is needed (Art. 65(3) of the Family Code of Ukraine); without it the other spouse can challenge the contract in court.
  • A child is among the owners. The contract needs permission from the guardianship authority (Art. 177(2)(3) of the Family Code).
  • The apartment was inherited. The law gives six months to accept an inheritance (Art. 1270(1) of the Civil Code), so the lawyer checks the certificate and the circle of heirs.
  • Redevelopment. If the technical passport does not match the apartment, we discuss legalising the changes before the deal.
  • The seller acts under a power of attorney. We check the representative's powers and the term of the power of attorney.
  • You are selling from abroad. Tax depends on your tax residency. The first sale within a year of housing owned for more than three years, or inherited, is tax-free for residents and non-residents alike (item 172.1 of the Tax Code of Ukraine). Otherwise a resident pays 5% personal income tax and a non-resident 18% (item 172.9), plus 5% military levy in both cases. The lawyer checks which rules apply to you.

Timing

The consultation takes 30 minutes; support timing is quoted in advance.

We agree the time of the consultation after your request. A written opinion is prepared once we have the documents, and we tell you the deadline in advance: it depends on the volume of documents and the question.

Support lasts until the contract is signed. When both parties' documents are ready, in our experience the contract is usually notarised in one meeting. If certificates, consents or a legalised redevelopment are missing, timing depends on the state authorities. A deposit paid before the review is a risk: if the buyer withdraws, the deposit stays with the seller (Art. 571 of the Civil Code), so the documents are best checked before it.

How much does a real estate lawyer consultation cost?

Why do I need a lawyer if a notary certifies the contract?

When should I bring in the lawyer?

Support can start at any stage. The other party's documents are best checked before the deposit: if the buyer withdraws, the deposit stays with the seller (Art. 571 of the Civil Code of Ukraine).
