Power of attorney from abroad
On what basis the agency acts on your behalf.
To sign documents and deal with third parties on your behalf, the agency needs a power of attorney. A power of attorney is the written document used for representation before third parties (Art. 244 of the Civil Code of Ukraine). Its form follows the form of the transaction: if the transaction must be notarised, the power of attorney is notarised too (Art. 245(1) of the Civil Code).
- In Ukraine: at any Ukrainian notary.
- Abroad: at a Ukrainian consulate, or at a local notary with an apostille. Ukraine is a party to the Hague Apostille Convention of 1961, in force for Ukraine since 22 December 2003 (HCCH status table). A document in a foreign language also needs a certified Ukrainian translation.
You decide the scope of the powers. The scope of work, timing and the agency fee are fixed in a written agreement before we start. The wording of the power of attorney can be checked by the agency's lawyer: legal support for property in Ukraine.
Tax on rental income
The owner, as the one receiving the income, pays the tax.
Income from letting housing is taxed at 18% personal income tax plus 5% military levy (Tax Code of Ukraine, items 167.1 and 170.1). If the tenant is an individual, the owner pays the tax after each quarter; if the tenant is a company or a sole proprietor (FOP), the tenant withholds it.
